TERMS & CONDITIONS1. Contents
All information including pictures, designs, logos, text, audio, videos contained within this website is copyright protected. Copying, reproducing, improper use, disclosing of information is strictly prohibited. EVS reserves the right to change and enhance the details within the website from time to time. Users are notified on these changes through the system's "Terms and Conditions".2. User Acceptance Terms and Conditions of EVS
EVS reserves the right to offer a login ID, password and Agent code to access our online reservation system to a travel agent, tour operator, wholesale travel Agent and any form of Business to Business Travel Agent providing hotel and other travel components booking service. Login access ID shall only be provided upon EVS receiving completed application form from the Agent. Access codes provided to Agent’s personnel or staff becomes the responsibility of the Agent. For security reasons access codes are not allowed to be transferred or disclosed to a third party. EVS reserves the right to change the access codes, It is the duty of the Agent to notify EVS on the termination/resignation of an employee of the organization so that such access codes can be de-activated to prevent misuse and possible liability of credit facility4. Rates
All rates quoted are NETT & NON-COMMISSIONABLE. Hotel Rates are per room per night basis, inclusive of all taxes and service charges. Transfers rates are on per vehicle basis while sightseeing tours and package tours are either on per vehicle basis or on per person basis .
If Hotel imposes any surcharge or increase room rates, the new rates will be applied to all reservations even if they were previously booked and confirmed5. Child Age Policy
Child age is subject to each Hotel’s Policy and is stated in the Hotel description. Such age policy and description are strictly based on the Hotel contract.6. Bookings Reservations Procedure
All bookings via www.emerging-view.com, provided rooms are available in the system, will be instantly confirmed and guaranteed to the hotel. If a booking is cancelled before the cancellation deadline, no charges will be imposed. If booking is cancelled after given deadline, cancellation charges shall apply, depending on each hotel's cancellation policy. Agents are responsible to read and understand the cancellation policy.
When a booking is confirmed, Agent can view the status on the screen and the system will generate an email to Agent accordingly. Number of guest allowed per room in hotels is defined in the booking inventory; Ages of child/children sharing rooms with adults must be specified during booking. Charges on extra bed and meals costs are strictly based on Hotel’s policy.
Additional night booking after original departure date will be treated as a new reservation. For most hotels, different rates apply for individual and group reservations. If reservations exceed eight (08) rooms, agent shall contact EVS at Tel: +65 6221 9118 or via email at email@example.com or fax to +65 6227 9118 to make reservations.7. Vouchers
Agents may use their own vouchers. All such vouchers should state the service provided on the voucher . Every voucher should also indicate the Confirmation Number and a printout from the booking system. Hotels and service providers may refuse to accept guest when information is incomplete, inaccurate and illegible.8. Special notes
If Agent books a transfer, or packages that have transfer element(s) in it, agent should inform EVS the latest updated flight details in order for us to arrange the transfer accordingly. Any amendments in flight details by the agent after confirmation of bookings should be immediately informed . EVS shall not be responsible for Agent’s failure to provide flight detail and the resulting missed transfers or any other issues caused by missing or wrong flight details..
The Agent shall be responsible to inform their customers to obtain necessary entry visas as required along with all relevant documentations such as passport bearing at least 6 months validity or as required by the destinations visited. The customer is also responsible for his/her baggage and personal belongings throughout the stay booked with EVS.
Standard facilities of similar hotel category are different from country to country according to the regulations applicable.
Accommodation information is generally provided by hotels; any inaccuracy is not under responsibility of EVS.
Properties may change name or trade name from time to time; this should not constitute as a change of hotel or modification of the reservation.
EVS is not responsible to provide the Agent with notice of renovation works at hotels or extensions of such renovation over the planned dates.
EVS shall not be responsible for any accident, loss, disturbance, delay or expense due to quarantine, strikes, any other event or force of nature, failure of any other means of conveyance or change in transit or hotel service and other causes over which EVS has no control.
EVS reserves the right to accept or decline any person as a member in a tour or to cancel or alter the tour.9.Credit and Cash Sales
Agents need to enter credit card details to make a reservation. Bookings will be confirmed only after EVS receives the approval payment from Visa and MasterCard. Once the booking is "confirmed" agent can print out the vouchers and invoices.
Agents will be fully responsible for payments made to EVS using Visa or Master Credit Card. Agents are also fully responsible for all bookings made under the Agent ID, Username and Password provided to the agent.10. Cancellations
System will indicate cancellation period for each hotel before the booking is finalized and accepted as confirmed. Agents are responsible to read and understand the cancellation policy. Every such cancellation request will be treated as a request to formally enter into a legal binding contract according to the terms and conditions in the system.
EVS must be notified in writing of any cancellation by fax or email. A notice is only considered to have been served provided that an acknowledgement and acceptance by EVS is obtained. Proof of sending does not constitute proof of receipt or acceptance of the cancellation notice.
When details of the cancellation penalty are not specified; it is the responsibility of the Agent to obtain clarification from EVS prior to making bookings. The failure by EVS to exercise the cancellation period does not signify a waiver of the right to charge such cancellation charges.11. Payment
Full payment must be received before 2 weeks before the client’s departure from Singapore. Failure to comply with this condition may result in the cancellation of all reservations without prior notice. If required, pro-forma invoice can be sent together with confirmation.

Payments via Bank Transfer - the remitter (Agent) shall bear all bank fees involved. OCBC Bank in Singapore must receive the full amount as stated in the pro-forma invoice. In the event of any dispute over invoices, the total sum claimed by EVS shall be paid first. After reconciliation between both parties, EVS will then issue a Credit Note or a Supplementary Invoice to effect the adjustment12. Refund
Any refund request should be reported within 32 days in writing with proof from the respective service provider. Partial refunds received in writing with proof within 32 days will be verified from the service provider, if any amount is partially refundable or totally non-refundable. Such cases will be processed after confirmation from the service provider and will be final and binding.
Under no circumstances can an agent deduct payment from an invoice either partial or in total without written approval from EVS. Refunds will be processed within a period of 32 days only, No further claims will be considered after a refund case is finalized and paid. After commencement of tours, no refund in full or in part will be given for services included in the programme that are not utilized.13.Liability
EVS is not itself a provider of accommodation, ground services, tours or any services provided; nor does it control the third parties who provide such services in connection with arrangements offered within the booking system.
EVS does not accept and hereby excludes all liabilities for the acts or omission whether negligent or otherwise of airlines, coach operators, tour operators, cruise/excursion companies, hoteliers or any person providing services in connection with the requested bookings made herewith. EVS further accepts no liability for any loss or damage caused by events beyond its control, where the featured properties and services in this agreement are booked by the agent and do not meet the expectations of the Agent’s customers. EVS shall not be liable for and shall be indemnified by the Agent in respect of any loss, either direct or indirect, third party claim suffered as a result of any incorrect or incomplete booking confirmed by the system.14.Complaints and Claims
All complaints are governed by the Liability clause (above) within the system, however all complaints should be lodged immediately with the provider of the service and also lodged with EVS who will earnestly endeavor to resolve or clarify such complaints without any liability.
All complaints should be reported immediately to the service provider, Hotelier, Supplier during guest stay, failure to do this would result in EVS ignoring the complaint. In any event EVS should be notified of all complaints within 15 days of the event giving rise to the complaint.
The agent shall bear full responsibility in an event the customer acts abnormally or displays antisocial behavior. EVS or its designated Service provider reserves the right to immediately cancel the customer’s stay and the agent will be charged for any amounts arising for the delinquent behavior of the customer which may be subject to claims by a third party.15.Law and Jurisdiction
All disputes arising out of the aforementioned terms and conditions shall be subject to the laws and exclusive jurisdiction of Government of Singapore.
